The Lazio Regional Administrative Court, with a recent ruling, clarifies the procedural and investigative profiles underlying the adoption of the provision, affirms the exclusive competence of ENAC in the matter, and highlights the reason of safety, capacity and available space, alternatively suitable to legitimize its assumption, must not be subjected to balancing with the economic interests of the private individuals involved.
