The contribution has as its object the commentary of the sentence Consiglio di Stato Sezione V sentenza 9 gennaio 2024 n. 282. This contribution aims to reflect on the issue of the institutions of the Limited Traffic Zones, from the point of view of reasonableness and proportionality, and to verify whether there are other tools for the protection of the environment and health, less invasive and probably more effective at the disposal of public administrators.
Il contributo ha per oggetto il commento alla sentenza Consiglio di Stato Sezione V sentenza 9 gennaio 2024 n. 282. Il presente contributo intende riflettere sul tema degli istituti delle Zone a Traffico Limitato, dal punto di vista della ragionevolezza e della proporzionalità, e verificare se vi siano altri strumenti di tutela dell’ambiente e della salute, meno invasivi e probabilmente più efficaci a disposizione degli amministratori pubblici.
