Don’t shoot the driver!
The ruling in question partially annulled Ministry of Infrastructure and Transport Decree No. 226/2024 and the related circulars, specifically regarding the mandatory twenty-minute time limit between booking and the start of a ride for rental with driver and the exclusive use of the ministerial app, deeming them disproportionate and detrimental to regional jurisdiction.
La sentenza in commento ha parzialmente annullato il decreto del Ministero delle infrastrutture e dei trasporti n. 226/2024 e le relative circolari, con particolare riferimento all’obbligo del vincolo temporale di venti minuti tra prenotazione e inizio corsa per gli NCC e l’uso esclusivo dell’app ministeriale, ritenendoli sproporzionati e lesivi della competenza regionale.
