“Pure” Transport Contract and Contract for the Provision of Transport Services: Distinctive Characters and Criteria.
From a conceptual standpoint, the boundary between a pure transport contract and a contract for the provision of transport services is blurred and indistinct. In practical terms, there are implications that are not easily resolved, partly due to the structure and complexity of the activities covered by the individual contractual arrangements entered into within the multifaceted landscape of modern commercial transactions.
The identification and examination of this issue hinges on the consideration of the fluidity of the scope within which the contract of carriage and the contract for the provision of transport services are situated.
The paper examines these aspects with a view to systematising those contracts that present certain distinctive features, such as the continuity of services, the multiplicity of transfers, the establishment of a complex business organisation, and the duration of the contractual relationship.
Sul piano concettuale il confine tra il contratto di trasporto puro e il contratto d’appalto di servizi di trasporto si rivela labile e sfumato, recando con sé implicazioni di non piana soluzione anche in ragione dell’articolazione e della complessità delle attività contemplate nelle singole operazioni negoziali poste in essere nel multiforme atteggiarsi degli odierni traffici commerciali.
L’enucleazione della questione e l’indagine su di essa si innesta sulla considerazione della mobilità del perimetro entro cui trovano sede il contratto di trasporto e il contratto d’appalto.
Il saggio indaga tali profili nell’ottica della sistematizzazione delle figure che presentano taluni elementi distintivi, quali la continuità delle prestazioni, la pluralità dei trasferimenti, la predisposizione di una complessa organizzazione imprenditoriale, la durata del rapporto negoziale.
