Informal collective bargaining in companies as a space for freedom: Reflections on the Ryanair case (Spain).

Informal or extra-statutory collective bargaining has frequently been seen in Spain as an accidental phenomenon, given the impossibility of reaching an agreement around a statutory collective agreement, of a normative nature and general personal effectiveness. However, negotiating processes such as the one that occurred within the airline company RYANAIR, with respect to its cabin crew, and the informal or extra-statutory collective agreement reached with the CC.OO. union, raise the opportunity for a reflection on the contours of informal collective bargaining as a space of freedom when reaching agreements that regulate labour relations within the framework of Spanish labour legislation, and its impact on the exercise of freedom of association and the right to collective bargaining.

En España, la negociación colectiva informal o extraestatutaria se ha considerado con frecuencia un fenómeno accidental, dada la imposibilidad de alcanzar un acuerdo en torno a un convenio colectivo estatutario, de carácter normativo y con eficacia personal general. Sin embargo, procesos de negociación como el ocurrido en la aerolínea Ryanair, con respecto a su tripulación de cabina, y el acuerdo colectivo informal o extraestatutario celebrado con el sindicato CC.OO., plantean la oportunidad de reflexionar sobre los límites de la negociación colectiva informal como espacio de libertad a la hora de alcanzar acuerdos que regulen las relaciones laborales en el marco de la legislación laboral española, y su impacto en el ejercicio de la libertad sindical y el derecho a la negociación colectiva.
