The co-marketing contract promoted by various public entities: mutual obligations.
The judgment in question reconstructs the contractual relationship that issued between the various territorial bodies involved in the operation to incentivize flights departing from Trapani-Birgi Airport. The Court, qualifying that relationship as a mandate contract granted to the Chamber of Commerce aimed at stipulating a co-marketing contract with Airport Marketing Services Limited, ascertained the failure of the Chamber of Commerce which did not give proof of the signing of the marketing contract and therefore declared that there is no payment obligation on the part of the Municipality of Pantelleria towards the Trapani Chamber of Commerce.
La sentenza in commento ricostruisce il rapporto contrattuale sorto tra i vari enti territoriali coinvolti nell’operazione di incentivazione di voli in partenza dall’Aeroporto di Trapani-Birgi. Il Tribunale, qualificando il rapporto insorto tra le parti in un contratto di mandato conferito alla Camera di Commercio volto alla stipula di un contratto di co-marketing con la Airport Marketing Services Limited, ha accertato l’inadempimento della Camera di Commercio che non ha dato prova dell’avvenuta sottoscrizione del contratto di marketing e per l’effetto ha dichiarato che non sussiste alcun obbligo di pagamento da parte del Comune di Pantelleria nei confronti della Camera di Commercio di Trapani.
