Competence of the Italian Transport Regulation Authority in motorway tolls: issues and perspectives for new toll models.
The study analyses the position held by the Italian Transport Regulation Authority for the regulation of motorway tolls as amended by Decree-Law no. 109 of 28 September 2018, converted with amendments by Law no. 130 of 16 November 2018. The end of the so-called double standard for the motorway tolls has caused many debates on the possible violation of contractual conditions by the Italian State: the text retraces these controversies starting from the comments expressed by the motorway companies during the preliminary consultation on the definition of a new toll model and following the recent decisions of the Council of State. At the end, the paper looks at the innovations introduced by Law no. 193 of 16 December 2024, the Annual Law on the Market and Competition 2023, and at the procedure for updating the toll system for motorway concessions, started in May 2024.
Il contributo esamina la posizione ricoperta dall’Autorità di regolazione dei trasporti in materia di regolazione delle tariffe autostradali per come modificata dal d.l. 28 settembre 2018 n. 109, convertito con modificazioni dalla l. 16 novembre 2018 n. 130. La fine del c.d. doppio binario per la definizione dei pedaggi ha scatenato non poche polemiche con riferimento alla potenziale violazione delle condizioni contrattuali da parte dello Stato italiano: tali perplessità vengono ripercorse nel testo alla luce delle considerazioni espresse da parte dei concessionari già nella fase delle consultazioni preventive per la definizione del nuovo modello tariffario unico e delle recenti sentenze del Consiglio di Stato. Infine, l’articolo si sofferma sulle novità introdotte con la l. 16 dicembre 2024, n. 193, Legge annuale per il mercato e la concorrenza 2023, e sul procedimento per l’aggiornamento del sistema tariffario di pedaggio relativo alle concessioni autostradali, avviato a maggio 2024.
